6. How must a facility demonstrate continuous compliance with the established emission limits?

A compliance period consists of 12 months.  Each month after the end of the initial compliance period is the end of a compliance period consisting of that month and the preceding 11 months (12-month rolling compliance period).  For each compliance period, continuous compliance may be demonstrated as follows:

  • Option 1: Compliant Material Option – In order to demonstrate continuous compliance for this option, a facility must show that the organic HAP content of each coating used in the coating operations during the compliance period is less than or equal to the applicable emission limit and each thinner and cleaning material used during the compliance period contains no organic HAP.
  • Option 2: Emission Rate Without Add-On Controls Option – In order to demonstrate continuous compliance for this option, a facility must show, based on the coatings, thinners, and cleaning materials applied in the coating operations during the compliance period, that the organic HAP emission rate is less than or equal to the applicable emission limits. This must be calculated as a rolling 12-month emission rate and determined on a monthly basis during the compliance period.
  • Option 3: Emission Rate With Add-On Controls Options – In order to demonstrate continuous compliance for this option, a facility must show, based on coatings, thinners, and cleaning materials used in the coating operations and the emission reductions achieved by the emission capture systems and add-on controls during the compliance period, that the organic HAP emission rate is less than or equal to the applicable emission limit. This must be calculated as a rolling 12-month emission rate and determined on a monthly basis. The facility must also maintain continuous achievement of operating limits, and operate according to their work practice plan and their SSMP (Startup, Shutdown and Malfunction Plan).

Records of continuous compliance must be maintained.
