2. What Sources Are Subject to the Final Rule?

The final rule applies to sources if that own or operate stationary RICE which are located at a major source of HAPemissions, except if the stationary RICE all have a site-rating of 500 brake HP or less. A major source of HAP emissions is a plant site that emits or has the potential to emit any single HAP at a rate of 10 tons (9.07 megagrams) or more per year or any combination of HAP at a rate of 25 tons (22.68 megagrams) or more per year.

EPA divided the stationary RICE source category into five subcategories:

(1) stationary RICE with a site-rating of 500 brake HP or less,
(2) emergency stationary RICE,
(3) limited use stationary RICE,
(4) stationary RICE that combust landfill gas or digester gas equivalent to 10 percent or more of the gross heat input on an annual basis, and
(5) other stationary RICE.

PipingEPA further divided the last subcategory into four subcategories:

(1) 2 stroke lean burn (2SLB) stationary RICE,  
(2) 4 stroke lean burn (4SLB) stationary RICE,
(3) 4 stroke rich burn (4SRB) stationary RICE, and
(4) compression ignition (CI) stationary RICE.

The final rule does not apply to stationary RICE test cells/stands since these facilities are covered by another NESHAP, subpart PPPPP of 40 CFR part 63.
