7. When must affected sources show intial compliance?

Existing affected sources must comply with the rule no later than 3 years after December 4, 2002. The effective date is December 4, 2002. New or reconstructed affected sources must comply upon start-up or December 4, 2002, whichever is later.

Before the initial compliance demonstration, one compliance option must be decided upon and the facility must state their choice in the initial notification to the Administrator.  Afterwards, the facility must monitor and report compliance results accordingly. If a facility decides to change to another emission limit option, appropriate notification to the Administrator is required.
