7. What are the notification, recordkeeping and reporting requirements?
Recordkeeping, initial notification and semiannual reporting is required by this rule. An initial notification is required within 120 days of the effective date of the NESHAP. That initial notification report should be very brief as it only serves to alert appropriate agencies (State agencies and EPA Regional Offices) of the existence of an affected source and puts them on notice for future compliance actions.
A pre-compliance report, which details compliance alternatives that require preapproval, is required six months prior to the actual compliance date for the affected source.
The notification of compliance status (NOCS) report, a comprehensive report that describes the affected source and the strategy being used to comply with applicable standards, is due 150 days after the compliance date of the NESHAP.
Additionally, a number of general provisions (Subpart A of 40 CFR part 63) has been incorporated into this final rule, such as the startup, shutdown and malfunction provisions. Facilities of affected sources must meet the notification, recordkeeping and reporting requirements of the applicable general provisions.
